Kirkpatrick Family Newsletter (1993), V.IV #2, p. 30: "In the year 1778 a John Kirkpatrick located on Buffalo Creek, Rockbridge County. He is listed as an Immigrant from Ulster, but he must have located elsewhere for some years as there were no immigrants from 1776 to 1781."
A John Kirkpatrick was indexed in the 1820 census of Rockbridge County, but the entry was not legible.
Rockbridge Co. deeds: 7 Mar 1778 John Collier and Jean his wife and Sisela Collier of Rockbridge County to John Kirkpatrick of Rockbridge Co., £500. 181 acres on North Branch of Buffalo Creek, bounded as follows: "Beginning at a cherry tree & mulberry on the Creek and runneth thence south 3 Degrees West fourty poles a hiccory and black Oak thence South seventy five Degrees west one hundred and seventy poles to a white Oak and ash thence South five west Sixty four poles to a white oak thence North seventy East two hundred & forty poles to a black oak & Dogwood thence South forty two East Sixty poles to a pine thence North forty Eight East Sixty poles to a pine thence North forty Eight East, Eighty two poles Croping the Creek to a white oak and black oak thence North forty two west one hundred and sixteen poles to a ---- oak near a great Spring thence North twenty west Eighty poles to a White oak bush thence South Seventy four West ninety four Poles to a red oak one the Creek and Down the same ninety four poles to the Beginning."
There is no John Kirkpatrick in the 1778 titheables of Rockbridge County. Three John Kirkpatricks were paying tax in 1782, one with 7 horses and 16 cows, one with 2 horses and one cow, and one with 6 horses and 16 cows. In the 1787 titheables, only one appeared, owning 8 horses and 12 cows (Schreiner-Yantis & Love, 1987). He was on tax list B and was visited on April 21, along with James McMath, several Wilsons, and numerous others. One John Kirkpatrick was granted an "ordinary license" for a tavern by the County Court July 7, 1778. A John Kirkpatrick witnessed a deed from Alexander and Sarah Collier to John Davidson, land situated on Collier's Creek, 20 Mar 1779. One John Kirkpatrick witnessed the will of Robert Kirkpatrick of Augusta Co., "Congregation of Providence." proved 7 Nov 1780. He witnessed a deed from Richard Williamson and wife to Smith Williamson 2 Mar 1782. 6 Jul 1784 a John Kirkpatrick participated in the appraisal of the estate of John Victory. The appraisers found only a certificate of service in the continental line, for which they could determine no monetary value. An appraisal of the estate of John Brown Dec 1788 included a note from a John Kirkpatrick for £40 paper due May 1779.

Court Orders: July 7 1778: "On the petition of John Kirkpatrick for a License to keep an ordinary at his house, leave is granted him on giving Scuritty, whereupon he together with Thos. Willson & Richd Williamson his Securities enetered into & acknowledged their bond in the sum of £50 for the Performance of an ordinary keeper." : "Sarah Gilmore Plff against John Kilpatrick Deft Tresspass on the Case. Dismissed at the Plaintiffs Costs." Apr 7, 1779: "Ordered that John Kurkpatrick son of Thomas Kirkpatrick, be constable." Aug 1, 1780, "...Joseph Alexander Captain, John Kirkpatrick Lieut., and James Lyle Ensign Produced their Commissions in Court and Qualified According to Law..." Jan 1, 1782: "John Kirkpatrick Constable Qualified according to Law." Oct 3, 1782: "John Kirkpatrick Plaintiff against Hannah Neely Defendant, Attachment. These suits are dismisses the Plaintiffs failing to prosecute." Mar 6, 1783: "John Kirkpatrick Plaintiff against James Cobham Defendant In Case. The Sheriff having returned these suits by order of the Plaintiffs are ordered to be discontinued." Mar 6, 1783: "Smith Williamson Plaintiff against John Kirkpatrick Defendant in debt. The defendant being arrested & not appearing tho solemnly called, on the Motion of the Plaintiff by his Attorney, it is ordered that Judgement be entered for his debt in the declaration mentioned unless the said defendant shall appear and plead to I-----, at the next Courts. Jun 3, 1783: "The Petition of John Kirkpatrick against David Kimsay and William Martin is ordered to be dismissed." Sep 8, 1784: "John Kirkpatrick Pllf against David Chambers and Solomon W. campbell Def. In Debt. This suit is ordered to be Discontinued." : John Kirkpatrick Pllf against George Fleming Def, Upon an attachment. The Sheriff having returned on the attachment Executed on one Black horse and one Cow of the Estate of the said Defendant and he not appearing though solemnly Called whereupon Judgement is granted to the Plaintiff against the Said defendant for the sum of £4:11:2 by account approved also his Costs by him in this behalf Expended, and it is ordered that he Sheriff Make sale of the aforesaid Horse and Cow..." Sep 6, 1785: Leave was granted in suit of John Galdoff against John Leach for the Defendant to take a deposition from John Kirkpatrick. May 2, 1786: John Kirkpatrick served on a Grand Jury, which was discharged due to "no presentments." Jun 6, 1786: Leave was granted for Joseph Williams to take a deposition from John Kirkpatrick, witness, in the suit of Thomas Lackey. Oct 3, 1786: "...John Kirkpatrick...Lieutenants...Came into Court and Qualified as militia officers according to Law."
Rockbridge Co. Deeds: 1 Dec 1782, mortgage from one John Kirkpatrick of Rockbridge to John Paxton of Rockbridge for the plantation on which Paxton now dwells including home and improvements, 180 acres, for £130. The appraisal of the estate of John Paxton showed £130 due from a John Kirkpatrick. This John, of Greenbriar Co., NC was released from his mortgage 4 Oct 1791.

John wrote his will in Rockbridge Co. on 18 April 1823. 1) To his wife Katherine during her widowhood the use of the house and kitchen in common with daughter Betsy and son Samuel. 2) Also to Katherine two beds & their furniture of her choice, two of her choice of his cows, the cupboard & its furniture &the kitchen furniture and her saddle and bridle and a living from the plantation. 3) Daughter Betsy, a living from the plantation, two beds & their furniture, a milch cow, and "my bay horse commonly called Thom which horse to be used on the plantation whilst Betsy remain unmarried but when she marries her living from the plantation shall cease." 4) Daughter Margaret Reid one horse least equal in value to the one given to Betsy. 5) sons James and Samuel use of the profits of the plantation during the lifetime of his wife provided they provide a living to her and to Betsy while she remains unmarried. 6) Son Samuel-one grey horse and a saddle and bridle 7) Son Andrew one bed and its furniture. 8) James at the death of my wife 2/3 and Samuel 1/3 of his land 9) To wife and daughter Betsy my loom and tacklings. 10) Wife- all hose furniture not mentioned 11)) Wife, Betsy & Samuel rest of cows, all sheep and hogs; James and Samuel-wheat fan my waggen & all other farming tools and utensils, all this if they furnish Margaret with the horse 11) James and Thomas executors.
