147. John[8] Kelley (A216). Born in MD?, Scotland/Ireland. Died, circa 1836, in Botetourt, VA.
An enumeration made in February and March 1785 of Botetourt Co. shows a John Kelley household with five white people, 1 house and 3 outbuildings in Neelly's District, and one with three white people, no houses and no outbuildings in Capt. Graham's district. The 1810 census listed John Kelly, Sr. with 1 male less than 10, 1 10-16, 1 16-26, 1 26-45, and 1 45 and up; and 1 female 10-16, 4 females 16-26, and 1 female 45 and up, no individuals not taxed and no slaves. There are John Kelleys listed in the Botetourt Co. censuses for 1820 and 1830. Two John Kelleys are listed in the 1820 Botetourt Co. Census. One living at "B.C." had 1 male 16-18, 2 males 18-26, 1 male 26-45, 1 male 45+, 2 females 26-45, 1 female 45+; 3 members were engaged in agriculture. Another had 1 male under 1, 1 male 18-26, 1 male 45+, 1 female 26-45, and one female 45+; three were engaged in agriculture; 5 male slaves.

"...part of a tract of land of which the late John Kelly died seized and possessed of and which was devised to the said William Kelly by the last Will and Testament of the said John Kelly."

A.E. Stamback (The Stamback Family Tree, 1931): "In a letter dated April 18, 1824 to his father-in-law, John Kelly in Virginia he [David Stamback] speaks of his journey of 34 days on the road and arriving at the home of his brother Isaac in this community Nov. 22, 1823."
There is a will dated 1836 and a settlement dated 1842 in Botetourt Co. There are deeds from John Kell(e)y to Robert Lyle (1819), George Rudisill (1837) and Michael Minich (1837). There are deeds from Samuel Reid (1794), Peter McConnell (1832), Joseph Cloyd (1837, John Kern (1837) and John H. Brown (1840).
Botetourt Co. Wills: "In the name of God Amen I John Kelly Sr. of Botetourt Co. and State of Virginia being old and infirm but of sound disposing mind and memory do make & ordain then my last will and testament in manner & found as follows to wit revoking all other wills by me heretofore made.- First it is my desire that all my just debts be Paid, of which there be but few if any. 2ndly I give to my wife Catherine Kelly one black Cow with a white face, with nine Dollars, one bed & furniture, one black walnut chest, one sorrel mare, with a ba-- face, two years old & her own saddle & one flax wheel, one dresser & the furniture usually there and two tin potts, two ovens & 2 kettles. 3rdly I give to my two sons William & Elijah Kelly all my land that I now own, jointly between them, on condition that they find me and my wife a sufficient & comfortable maintenance during our lives. Said William and Elijah is to have the homes they now claim, also the waggon and gear that is now used on the plantation. Elijah is also to have one red & white two year heifer & one Cow, white, Said William & Elijah is also each to have a bed of furniture. 4thly I give to my daughter Rhoda one bed & furniture one cotton wheel & one flax wheel, two red Cows, one brided yearling & one black yearling. 5thly It is my desire that all my personal property of every description that is not herein mentioned be sold on a Credit of twelve months and the money arising therefrom be equally divided between Henry Kelly, George Kelly, John Kelly, Polly Stanback, Sarah Coalter, Elizabeth Stanback, & Hanah Snider. Lastly I do Constitute and appoint my wife Catherine Kelly & William Richardson executors of this my last will & testament. In witness whereof I have hereunto subscribed my name this 21st day of January 1826./ In presence of Lewis Cooper, Samuel Richardson, Thomas Richardson.
