According to Littell (1852), he was a Justice of the Peace." The Morris Co. History lists Benjamin Day as a Justice of the Peace, with a commission issued April 30, 1768.

New Jersey Ratables 1778-80 listed Benjamin Day, Esq. of Morris Twp. with 70 acres, 2 horses, 6 cattle, 1 hog.

The will of Benjamin Day of Morristown, Morris Co. was dated Sept. 16, 1783, with administrators Elizabeth Day and Stephen Day, both of said county. Moses Day of Morristown was the bondsman.

He married[88], first, Elizabeth or Abigail Darling, 3 Jul 1751, in

Morristown, Morris Co., NJ[53]. Children:
